The Florida Attorney General's office subpoenaed Discord seeking extensive documentation about the platform's marketing to children, age-verification requirements, content moderation policies, parental controls, and reporting procedures for exploitative activity. The investigation alleges Discord may have violated Florida's Deceptive and Unfair Trade Practices Act through insufficient protections for minors on its platform.
"Groomers and predators seem to believe that they can get away with targeting children on Discord—and we are going to find out why," Uthmeier said in announcing the probe. "Discord owes us an explanation on the overwhelming use of its platform among predators, and what they are doing to protect children." The AG's office cited concerning reports that predators contact minors on other platforms like Roblox and Fortnite before moving communications to Discord.
The subpoena demands Discord produce marketing materials representing the platform's safety for children, procedures for content moderation, records of exploitation complaints and responsive actions, age-verification processes, parental control documentation, records from criminal cases involving children, and data on child users. The filing indicates the state believes Discord has created an exploitative environment for minors through inadequate safety measures.
This investigation represents part of a broader enforcement trend targeting social media platforms over child safety. The probe follows numerous criminal investigations in Florida that have traced predatory activity back to Discord's platform, according to the AG's office. The action reflects growing scrutiny of gaming and social platforms where children congregate online.
"Investigations show that offenders are using platforms like Roblox and Discord as an access point to reach children," said Sarasota County Sheriff Kurt A. Hoffman, who supports the investigation. "My message is clear, we are committed to protecting our kids, and predators have no safe place in our community. If you exploit children, we will find you, arrest you, and hold you accountable."
The civil investigation focuses on Discord's role as a communication hub for predators who allegedly use the platform to distribute child sexual abuse material and groom minors. The state's theory appears to center on Discord's marketing practices and whether the company adequately discloses safety risks to parents while promoting the platform's suitability for children.
This enforcement action signals Florida's aggressive approach to holding tech platforms accountable for child safety failures. The investigation could lead to significant penalties under Florida's consumer protection laws if the state proves Discord engaged in deceptive practices regarding its safety features and child protections.
