U.S. District Judge John R. Tunheim granted Sysco’s motion for reconsideration on May 4, 2026, vacating a March 2025 order that had enforced the settlement. The ruling also denied JBS’s motions to enforce the agreement or dismiss the claims.
The two-page order, filed in the Cattle and Beef Antitrust Litigation, cites the Seventh Circuit’s recent decision in In re Broiler Chicken Antitrust Litig., 167 F.4th 430 (7th Cir. 2026), in granting the motion.
JBS did not oppose Sysco’s motion for reconsideration.
The ruling vacates the court’s prior memorandum opinion and order that had adopted a report and recommendation enforcing the settlement. It also vacates the judgments entered on that basis in both the pork antitrust case (Civil No. 18-1776) and the cattle and beef MDL (MDL No. 22-3031).
Consequently, JBS’s motion to enforce the settlement with Sysco and its motion for summary dismissal of Sysco’s claims are both denied.
Sysco’s antitrust claims against JBS are now reinstated in both matters.
