SAN FRANCISCO (LN) — A federal judge in the Northern District of California granted Anna Hong’s motion for leave to amend her complaint, adding two new named plaintiffs to her putative class action against RugsUSA, LLC, according to an order filed May 29.
The order, signed by U.S. District Judge Araceli Martínez-Olguín, requires Hong to file the proposed amended complaint as a standalone docket entry by noon on May 29. RugsUSA has 28 days date to submit a responsive pleading.
If RugsUSA files an answer, discovery will close July 31, 2026, and plaintiffs’ deadline to move for class certification will be September 4, 2026. If RugsUSA instead files a Rule 12 motion, the parties must meet and confer and propose a revised schedule within seven days after the order resolving that motion.
The court noted that discovery on issues related to class certification has been closed since February 23, 2026. Discovery is now re-opened solely to permit RugsUSA to assess the claims and potential representation of the two newly named plaintiffs.
The order further provides that written discovery previously propounded on Hong by RugsUSA is deemed effectively propounded on the two new plaintiffs as of May 29. The new plaintiffs must respond to written discovery in a timely manner and be available for depositions. Any further written discovery requests plaintiffs to RugsUSA are limited to the individual facts of those plaintiffs’ purchases.
