What the complaint alleges
Genentech, Inc. and Hoffmann-La Roche Inc. sued Biocon Biologics Inc., Biocon Biologics Ltd., Biocon Biologics UK Ltd., and Biocon Biologics Germany GmbH in the U.S. District Court for the District of New Jersey for patent infringement. The lawsuit arises from Biocon's submission of an abbreviated Biologics License Application (aBLA) seeking FDA approval to market Bmab1500, a biosimilar version of Genentech's cancer drug PERJETA® (pertuzumab), without independently developing the product. Plaintiffs allege that Biocon's aBLA filing infringes numerous patents covering PERJETA® and its manufacture.
