What the complaint alleges
DuraPlas, LP sued non-party Premier Distribution Cooperative, Inc., doing business as Blue Hawk Distribution or Blue Hawk Cooperative, in the U.S. District Court for the Northern District of Illinois. The motion seeks to compel Blue Hawk to comply with a document subpoena issued in connection with an underlying antitrust and patent action in the Northern District of Texas, DuraPlas, LP v. DiversiTech Corporation. DuraPlas alleges that Blue Hawk has failed to produce documents central to its claims challenging DiversiTech’s anticompetitive exclusive dealing arrangements, despite more than eight months of negotiations and narrowing of requests.
