What the complaint alleges
Protecting Access to Retail Pharmacy, LLC d/b/a TRUST, LLC and nearly 5,000 pharmacies sued Prime Therapeutics, LLC in the United States District Court for the Western District of Washington. They allege that Prime entered into an unlawful price-fixing agreement with co-conspirator Express Scripts to deflate reimbursement rates and inflate fees paid by pharmacies, violating the Sherman Antitrust Act. They also claim that this agreement caused Prime to breach its contracts with the plaintiff pharmacies by imposing rates and fees inconsistent with the contract terms.
