What the complaint alleges
Mondelēz Global LLC, Nestlé USA, The Hershey Company, The J. M. Smucker Company, The Kraft Heinz Company, and WK Kellogg Co (Plaintiffs) sued ASR Group International, ASR/Domino entities, United Sugar cooperative members, Commodity Information, Inc., and Richard Wistisen in the U.S. District Court for the Northern District of Illinois. The complaint alleges that from at least January 2017 through October 2024, the defendants conspired to fix, raise, maintain, or stabilize granulated sugar prices by exchanging confidential, non-public price and sales data through the Commodity Defendants, which acted as a clearinghouse. Plaintiffs claim they paid artificially inflated prices for sugar as a direct result of this conspiracy.
